It is possible that one of these cases could be decided by the Supreme Court. Instead the court ended up ducking the key issue there. By inserting itself to attempt to end the debate over abortion, the Court instead has both politicized itself and ensured that that the issue remains at the forefront of every national election.

Since the announcement, speculation has run rampant about what this could mean for the future of abortion as we know it, as the loss of Kennedy-the major swing vote on abortion-upsets the Court's decades-long pro-choice majority.

But the most consequential decision of all, of course, was Kennedy's retirement, announced soon after the court adjourned for the summer.

Cuomo also called on the state Senate to hold a special session to pass legislation that would codify Roe v. Wade in NY before the next Supreme Court justice is confirmed. That's in a more precarious spot, even though it has 2-1 support, according to Quinnipiac.

"Despite being only 53 years of age, Judge Kavanaugh has more than 12 years' experience as a judge on the most prestigious federal appeals court in the country", said Rev. Jason J. McGuire, the group's executive director.

The state Assembly has passed legislation that would expand abortion protections.
