Officer resigns after dispute over Puerto Rican shirt

A police officer who drew criticism for allegedly failing to intervene in a dispute between a man and a woman over the woman's Puerto Rico flag shirt has resigned, officials said Wednesday evening.

Timothy Trybus, 62, is facing two charges of felony hate crimes, which are enhancements to the previous charge of misdemeanor assault and disorderly conduct. Trybus was arrested and charged with assault and disorderly conduct.

Trybus could face up to five years in prison for each of the hate crime charges.

Mia Irizarry said she was celebrating her 24th birthday at Caldwell Woods park when the man approached her and asked her why she was wearing the sleeveless Puerto Rico flag shirt. Trybus asks in the video.

The video even got the attention of Puerto Rico Governor Ricardo Rosello, who said he was "appalled, shocked, and disturbed by the officer's behavior".

"If the investigation confirms the officer did not take appropriate steps to ensure public safety, disciplinary action will be swift", Forest Preserves spokeswoman Stacina Stagner told ABC News via email earlier this week.

She said the incident went on much longer than the video showed, even after Trybus was in custody and placed in a squad vehicle. Irizarry can be heard asking a park police officer for help, and telling him that she is uncomfortable.

Irizzary was wearing a shirt made to look like the Puerto Rico flag, with the words "Puerto Rico" written on the top.

In a statement announcing Connor's resignation, officials with the Forest Preserve District of Cook County said that they planned to further address "aspects of this incident" and that they would not provide additional details until Thursday.

Eventually, the first officer on the scene takes notes of Irizarry's account of the incident and says he was at the scene due to the separate incident, noting she was not being attacked though acknowledging she felt threatened. Puerto Rico is a USA commonwealth.
