Dr. Carl Herbert, president and medical director at the Pacific Fertility Center in San Francisco, told ABC News that in his 35 years of Cryopreservation it is an "an unusual event" where two clinics and two liquid nitrogen storage tanks where the tissues are stored "failed".

In a statement Sunday, the hospital said it understood why some might sue. Hospital officials say about 700 patients are affected. "With this lawsuit, we will get answers and stop this from happening again".

Samples would need to be unthawed to determine whether they've been damaged.

The facility has set up a call center for patients to arrange and appointment or calls to speak with their physicians.
