Interpol cancels Red Corner notice against Zakir Naik

India has chose to file a fresh petition before the Interpol after the agency rejected a red corner notice against radical Islamic preacher, Dr Zakir Naik.

"The commission further pointed that the information published by the Ministry of External Affairs on its guidelines for extradition appears different from that provided by the National Central Bureau (NCB) of Interpol of India, concerning the requirement to include charge sheet for extradition".

The decision was sent to the Interpol General secretariat which deleted the data from the Interpol's files in November 2017. However, the National Investigation Agency (NIA) said it will submit a fresh request for the same after completing requisite formalities, sources said on Saturday.

Naik said, "I am relieved by Interpol cancelling RCN, but I would have been more relieved had the Indian government cleared me of all the false charges". Its report says that, after thorough examination it considered retention of data does not comply with the Interpol rules and it forwarded the same to other officers. It cited the Indian government guidelines that require extradition request for an accused fugitive to be initiated only after a chargesheet has been filed.

Naik had earlier petitioned the Interpol to not issue RCN against him as he was being targeted as part of religious persecution against minorities in India. "We are sure Interpol will issue RCN this time", a home ministry official said. NIA, in response, had contested Naik's claims and written to Interpol that he was not only a terror suspect but also wanted for inciting communal hatred.

"NIA's request for Red Notice against Zakir Naik was not accepted by Interpol as chargesheet had not been filed when request was submitted to the Interpol HQ". The charge sheet was filed under the section 10 UA (P) Act and Sections 120B, 153A, 295A, 298 and 505 (2) of Indian Penal Code. Naik has been named as an absconding accused.

NIA registered a case against Naik on November 1, 2016, in Mumbai.

The Modi government has already banned the IRF for five years. But during his interactions with the Indian media, Naik has repeatedly denied all the charges levelled on him.
