Federal court reinstates Ezekiel Elliott's 6 game suspension

The Federal appeals court has cleared the way for the NFL's six-game suspension of Dallas Cowboys running back Ezekiel Elliott's. The Cowboys are on bye for Week 6.

Calling the lawsuit, which was filed by the N.F.L. Players Association on Elliott's behalf, "premature", the court ruled that a district court, which had issued an injunction blocking the suspension from being enforced, lacked subject matter jurisdiction to adjudicate the appeal and vacated its injunction. Dallas next plays October 22 in San Francisco. Alfred Morris and Darren McFadden stand to fill in for Elliott if the suspension is upheld.

The company said its estimates are "preliminary and dependent on broad assumptions about coverage, liability and reinsurance". The estimated losses are approximately evenly split between XL Group's insurance and reinsurance segments.

The ruling came after oral arguments were conducted last week in New Orleans before a three-judge panel of the court.

Goodell suspended Elliott after a year-long investigation into domestic violence accusations made by his former girlfriend, Tiffany Thompson. "We will review the decision in greater detail and discuss next steps with counsel, both in the district court and federal court of appeals". Mazzant ruled that Elliott did not receive a fair appeal hearing before Henderson, in large part because Elliott's accuser and Goodell did not testify.

The judges voted 2-1 to grant the NFL's emergency request and ordered the U.S. Eastern District Court in Sherman to dismiss Elliott's case. The league's headquarters is in Manhattan, not Texas, and other cases, including the fight between the league and New England Patriots quarterback Tom Brady, were heard in that court.

Elliott, the league's leading rusher last season as a rookie, has totaled 393 rushing yards in five games this season.
